An act relating to the expansion of the right to carry arms in New Jersey.

Be it enacted by the Youth Model Legislature of the State of New Jersey that

New Jersey shall expand its right to carry laws from a May-Issue to Shall Issue.

Section I:

Right-to-carry also known as concealed carry is an individual’s ability to publically possess a weapon under the condition that it is not visible to the public.

Section II:

All citizens of the State of New Jersey who meet the specified criteria will be given a concealed carry permit if they desire one.

Section III:

All individuals who wish to obtain a concealed carry permit must be over the age of 18.

Section IV:

All individuals who wish to obtain a right to carry permit must undergo a thorough background check at their own expense.

Section V:

No citizen who has committed a felony, either federal or state will be allowed to obtain a right to carry permit.

Section VI:

No citizen who has committed a Class I or Class II misdemeanor will be allowed to obtain a right to carry permit within ten years of their conviction.

Section VII:

All citizens who wish to obtain a right to carry permit must complete ten hours of fire arms training before they obtain the permit, and must complete five hours of training once every five years after obtaining the permit.

Section VIII:

The firearms permitted by the right to carry permit will be restricted to semiautomatic pistols and revolvers with a maximum bullet size of .45 caliber.

Section IX:

There will be an opt-out provision to allow businesses to restrict the concealed carry within their businesses. Any business has the right to prohibit citizens from posessing firearms within the confines of their business.

Section X:

Firearms will not be allowed onto school property, including state owned universities, throughout the State of New Jersey.

Section XI:

Any individual with a mental illness of any kind will not be permitted to obtain a right to carry permit.

Section XII:

Right to carry permits must be renewed once every five years, and background checks will be required for renewal at the owners expense.

Section XIII:

The State of New Jersey reserves the right to confiscate a right to carry permit if any of these restrictions are violated.

     
Statement of Intent: The purpose of this Bill is to protect individual's gun ownership rights in the State of New Jersey

Effective Date: This Bill shall take effect January 1, 2011.

Financial Statement: The cost of this bill shall be $5,000 for the rewriting and redistribution of the law books.
