AN ACT to mend the discontinuity in the New Jersey Mental Health Parity Law.

Be it enacted by the Youth Model Legislature of the State of New Jersey that mental health insurance and substance abuse rates will be equivalent to medical, health and surgical insurance rates.

Section I: The New Jersey Mental Health Parity Law will be revised to require insurance companies to provide mental health insurance coverage equal to that of medical and surgical coverage.

Section II: The deductibles, co-payment rates, out-of-network charges, inpatient day and outpatient visit limits for those who need mental health coverage will be equal to that of medical and surgical insurance.

Section III: Substance abuse victims will be covered by insurance carriers in the state of New Jersey. Insurance rates, deductibles, co-payments, out-of-network charges, inpatient and outpatient visit limits for those who need substance abuse coverage will be equivalent to the rates of medical and surgical health insurance.

Section IV: Under the new legislation, there will be a fine for insurance carriers who do not advocate the law.

Section V: The fines/penalties for an infringement of the law is as follows:

First Offence- a monetary fine of $100,000

Second Offence- a monetary fine of $500,000 and state-regulated inspections from third-party auditors

Third Offence- Control of the offending insurance company will be given to the state government

Section VI: Monies collected from fines will be donated to New Jersey mental health and substance abuse rehabilitation centers.

     
Statement of Intent: The purpose of this bill is to equalize mental health and surgical insurance rates.

Effective Date: This Bill will take effect on July 1, 2011.

Financial Statement: Rewriting of textbooks to be determined by the Treasury Department of the New Jersey Youth Legislature.
